- Information about care needs (including disabilities, home conditions, medication and dietary requirements and general care provisions)
- Test results (including psychological evaluations, scans, bloods, x-rays, tissue tests and genetic tests)
- Payment details (including card or bank information for transfers and direct debits)

- Contract – we have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.
- Legal obligation – we have to collect or use your information so we can comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability.
- Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:
- The information is collected to ensure that the correct audiological care is provided, that any need for onward referral to another Health Provider, such as GP, Ear Nose & Throat Consultant is appropriately made. It is important that information about yours or your child’s medical history is known so we can identify risks for hearing loss, or information that supports ongoing audiological management.

How long we keep information
Claire Benton Audiology is committed to managing health records in accordance with UK law, including the Records Management Code of Practice for Health and Social Care and the UK General Data Protection Regulation (UK GDPR).
Retention Periods
We retain health records for the following minimum durations:
- Adults:
Health records are retained for 8 years after the conclusion of treatment or the last contact with the service. - Children and Young People:
Records are retained until the patient’s 25th birthday, or 26th birthday if the young person was 17 at the conclusion of treatment.
If the child dies before reaching adulthood, records are retained for 8 years after death. - Deceased Patients:
Records are retained for 10 years after death.
These periods reflect national guidance and may be extended in specific circumstances, such as legal proceedings, safeguarding concerns, or public inquiries.
Data Security and Disposal
All records are stored securely in accordance with UK GDPR and the Data Protection Act 2018. When records reach the end of their retention period, they are disposed of securely using approved methods to ensure confidentiality is maintained.
Electronic Records
Electronic records are managed in line with the same retention schedule. Where systems allow, records may be deleted or rendered inaccessible (“put beyond use”) following formal risk assessment and audit logging.

Duty of confidentiality
We are subject to a common law duty of confidentiality. However, there are circumstances where we will share relevant health and care information. These are where:

- on a case-by-case basis, the public interest to collect, share and use the data overrides the public interest served by protecting the duty of confidentiality (for example sharing information with the police to support the detection or prevention of serious crime);
- If in England or Wales – the requirements of The Health Service (Control of Patient Information) Regulations 2002 are satisfied; or
